Hernández Contreras, Martínez & Fitch, Abogados (HCM&F Abogados, SC), is a firm established fifty years ago by applicant lawyers, focused on legal counsel and litigation, providing professional services, both to individuals and companies, mostly in Corporate Law, Civil Law, Family Law, Commercial Law, Labor and Criminal matters, Tax Criminal Law and Administrative Law.

The firm was established by its founding partners Carlos Hernández Mendieta, Camila Graciela Contreras Blanquet and Esperanza Zepeda Contreras, specialized in Public and Private Law, working in various areas of consulting and litigation in the aforementioned matters, calling themselves then Hernández Contreras, Abogados, S.C.

Carlos Hernández Mendieta Postulant lawyer graduated from the National Autonomous University of Mexico (UNAM) in 1972, who stood out in the field of civil litigation until his death in 2004.

Camila Graciela Contreras Blanquet Postulant lawyer graduated from the National Autonomous University of Mexico (UNAM) in 1971, who excelled in the field of civil and corporate law, in the last years of her professional life she worked within the Special Affairs Division of the Legal Department of the Mexican Social Security Institute (IMSS).

Esperanza Zepeda Contreras Postulant lawyer graduated from the National Autonomous University of Mexico (UNAM) in 1967, who has excelled in the workplace, her last performance in working life was in the public service as Assistant Secretary for Technical Information and Documentation of the Federal Board of Conciliation and Arbitration.

Initially having only 6 members and a single office located in Mexico City, the firm undertook the task of advising and offering its clients the services and experience in the indicated topics.

As per the Firm expansion, it changed its name to Hernández Contreras, Martínez & Fitch, Abogados (HCM&F Abogados, S.C.), made up of four partners who are in control of the affairs, which are attended by a highly trained staff made up of 24 members, including legal and administrative personnel in their offices in Mexico City. Likewise, it has various correspondent offices through which it also attends the affairs of its clients in different States and the main cities of the Country, such as Cancun, Guadalajara, Monterrey, Morelia, Querétaro, Tijuana and Toluca.

When these controversies are presented before the judicial authorities, the Firm provides the procedural follow-up either from the filing of the claim or response to it, until the issuance of the sentence that resolves it, including the Amparo Trial, previously exhausting the ordinary resources established by law.

In this matter, we have the experience in advising and managing customs clearance procedures, we assist in the purchase or sale of goods and services carried out outside our border, taking advantage of the benefits that each country can offer within their legal framework, as well as international treaties, of which we have full knowledge.

  • Handle administrative procedures and arbitrations raised from claims filed by users of financial services before the National Commission for the Defense and Protection of Users of Financial Services (CONDUSEF), in each and every one of the delegations of Mexico City and the metropolitan area, and other procedures provided for in the relevant Law, likewise, Remedy Appeals, Nullity Trials, Constitutional Guarantee Trial against resolutions issued by said Commission.
  • Handle administrative procedures and arbitrations raised from Claims filed by patients before the National Commission of Medical Arbitration (CONAMED), in each and every one of the delegations of Mexico City and the metropolitan area, and other procedures provided by the relevant Law, also, Remedy Appeals, Nullity Trials, Constitutional Guarantee Trial against resolutions issued by said Commission.

  • The advice, design and instrumentation of divorce trials and the multiple situations raised from family controversies (e.g., the annulment of the same, maintenance, fixing and modification of alimony).

The services that comprise the practice of this branch of law in Hernández Contreras, Martínez & Fitch, Abogados, are the consultancy, advice and procedural processing before any type of authorities of the common or federal jurisdiction, being specialists in handling felonies of Legal-Criminal complexity, such as fiscal, financial, stock exchange, patrimonial crimes, and crimes related to industrial and intellectual property, as well as crimes committed by public officers, illegal enrichment, influence peddling and crimes provided for in special laws, among others.

Derived from the constant changes that the matter is undergoing and the need for updating, we have a large team of lawyers who are perfectly trained and experienced in criminal litigation, in which their participation begins from the Investigation Portfolio and extends during the complementary investigation, the intermediate stage and the oral trial.

Representing at all times the interests of our clients as defenders or legal advisers to the victim, covering each and every one of the stages of the Accusatory Penal System due to the Constitutional Reforms in the matter of 2008, consisting of:

  • 1. Investigation: complaint, the prosecution's investigation file, interviews, early proof, until the presentation before the Control Judge.

The representation of diverse physical and moral persons, acting as Legal Representative, obtaining the recovery of diverse properties, as well as the consignment of diverse fraudsters and the repair of the damage, likewise the interposition of diverse Guarantees Trials in obtaining favorable resolutions to the interests of those represented.

In the same way, we support clients recovering and releasing goods and merchandise located in containers involved in criminal proceedings, due to circumstances unrelated to their activities, having to stand before the Attorney General of the Republic (FGR), through the Specialized Prosecutor for Organized Crime (FEMDO) and the Prosecutors assigned to the Specialized Unit for the Investigation of Terrorism, Stockpiling and Trafficking of Arms (UEITA) of the FEMDO, evidencing the legitimacy and legality of the merchandise that has been disputed.

In this branch our firm has specialized its attention given that Mexican labor laws are unique in their kind, since they predominantly protect the worker over the employer, granting non-waivable rights and benefits.

This area encompasses all aspects of labor-management relations, so we offer advisory and legal processing services for trials before any labor authority, understood as the Ministry of Labor and Social Welfare, the local or federal Conciliation and Arbitration Boards, the Conciliation and Arbitration Courts, and the local or federal Offices of the Labor and Social Welfare Defense Attorney.

We also offer advice and consultancy on the supervision and verification of compliance with the obligations of the telecommunications and radiocommunications related to regulated services:

  • 1. The obligations and conditions established in the Federal Telecommunications and Radio communications Law, in the concession titles, authorizations and other applicable legal, regulatory and administrative provisions.
  • 2. Supervision and confirmation that payments for rights, products and uses of concessions, authorized persons and other regulated subjects, are made according to the relevant fares and regulations.
  • 3. Review the guarantees of compliance with obligations or conditions that must be presented by concessionaires, authorized parties and other regulated subjects, as well as cancel or release them before the authority.
  • 4. Advise to achieve the issuance of the positive opinion on the fulfillment of the obligations provided in the laws and in the concession titles in the cases that it is intended to request an authorization to provide additional services.
  • 5. Analysis of the quarterly reports of the results of the verifications of the service quality indexes for digital terrestrial television and broadcasting that use the radio spectrum, with the indicators, parameters and procedures established by the Institute.
  • 6. Advise on filing requests for assignment, modification or extension of concessions in the field of telecommunications and radiocommunications that will be submitted for consideration by the Plenary.
  • 7. Advise on filing procedures related to requests for changes in share control, ownership or operation of companies related to concessions and permits in the field of telecommunications and radiocommunications that will be submitted for consideration by the Plenary.

Lawyer of this firm who began working in 1990 and became a partner from 1997, the date on which he graduated from the National Autonomous University of Mexico, where he obtained the title of Law Degree with the thesis called "Proposal for regulate the transfer of the contract in the Civil Code for the Federal District"; within his practice includes matters related to Corporate and Real Estate Law, as well as the representation of his Clients before jurisdictional and administrative authorities at Federal and State levels. Some relevant jurisdictional precedents of the Supreme Court of Justice of the Nation and the Federal Court of Fiscal and Administrative Justice have been created by the issues discussed in the trials sponsored by him.

It has been constantly updated before various institutions, through courses in various areas of civil, commercial, family and franchise litigation, as well as forensic practice in oral commercial proceedings, which have been taught by the Court Superior of Justice of Mexico City, by the Supreme Court of Justice of the Nation and the Council of the Federal Judiciary in matters of Amparo and Constitutional Law.

Francisco Javier Ramos Delgado

He has a degree in Law with 16 years of experience in the federal public service. He has held management positions in the Attorney General's Office, the Federal Prosecutor's Office and the National Migration Institute, in which he developed knowledge in the areas of amparo trials, supervision and inspection, smuggling, among others.

He also worked in the Judicial Branch of the Federation as a Project Secretary, where he was in charge of the substantiation of amparo trials in administrative matters, the resolution of incidents and the fulfillment of sentences.

From 2010 to 2015, he held the positions of Deputy Director General of Conciliations and later, Deputy Director General of Public Works Regulations, both in the Secretariat of Public Service, in which he was responsible for substantiating the conciliation procedures provided for in the laws of Public Works, Related Services (LOPSRM) and Acquisitions, Leases and Services of the Public Sector (LAASSP), and in their respective regulations.

Due to the above, he learned firsthand about the different problems that arise in the execution of public works contracts, as well as acquisitions, leases and services, in order to find satisfactory solutions for companies and agencies, within the legal framework.
